Throughout the Terms of Service, the terms “we”, “us” and “our” and "Service Provider" refer to dilisense GmbH. By visiting the website and using our services (the "Service"), you (also referred to as the "User" or "Client") accept the Terms of Service as well as the Privacy Policy. If for any reason you don’t want or cannot accept the Terms of Service and Privacy Policy, you must not use our Service.
The acceptance of the Terms of Service and Privacy Policy are not a guarantee for being able to access our Service. Subject to an individual contractual agreement to the contrary under which access to the Service and the respective API is provided for a fee (a "Paid Service Agreement"), we reserve the right to cease the provision of the Service or refuse access to our Service to anyone for any reason and at any time, without any prior notice.

You understand that through your use of our Service you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information for storage and processing.
Our Service is based on, and grants access to, data which partly is publicly available and partly is proprietary. The current overview of all sources from which data is taken and included in our Service (the "Data Sources") can be found on https://dilisense.com/en/sources.
Certain functionalities of the Service are only available to Registered Clients and/or under Paid Service Agreements, as set out below.
Besides the information provided on the website, we offer a free AML search functionality for sanctioned individuals and entities, PEPs (Politically Exposed Persons) and criminals. The search is not limited with regards to the number of usages via the website. Please note that the sources included in the Services under the Paid Service Agreements differ from the Free AML search.
This functionality is available to all Clients.
We additionally offer the "dilisense AML Screening API" ("AML Screening API"), a service that provides you with machine-to-machine access to the dilisense methods for checking for sanctioned individuals and entities, PEPs (Politically Exposed Persons) and criminals. Our APIs are REST based and as such accept GET requests with the parameters specified in the API documentation.
The AML Screening API is available to Registered Clients and under Paid Service Agreements.
Under Paid Service Agreements, we additionally offer the "dilisense AML Database" ("AML Database"), which is a service that provides you with a full export of our database to check for sanctioned individuals and entities, PEPs (Politically Exposed Persons) and criminals on premise. The list is in JSON lines format and is updated multiple times per day and available for download via API.
We additionally offer the "dilisense batch processing" ("Batch Processing"), which is a service that provides you with access to our database via Excel spreadsheet to check for sanctioned individuals and entities, PEPs (Politically Exposed Persons) and criminals.
Batch Processing is available to Registered Clients and under Paid Service Agreements.
The rescreening of names can also take place on our infrastructure with the "Ongoing Monitoring" service. This allows the registration of individual or entity names via API and screens them against our database every time an update is received for the covered AML, KYC and CTF sources. When a change for a registered name is identified, a notification is sent out to a webhook registered by the Client. A separate data processing agreement is required. The Ongoing Monitoring service is available under Paid Service Agreements.
Registered Clients and Clients who have entered into a Paid Service Agreement further have access to the account area, in which Clients can find their API key, add and remove credit card information and find their plan features including the current usage of our Service.
By registering an account with us, you consent to receive communications from our team related to your account. These communications may include important service updates, security notices, administrative messages, and promotional information about our products and services. You acknowledge that such communications are essential for the proper operation of your account. While you may opt out of receiving promotional messages at any time by contacting us, you understand that it may not be possible to opt out of all service-related notifications.
The content provided on our website, including but not limited to texts, documents, reports, images, and any other material, is for informational purposes only. The information is not intended to be a substitute for professional advice, nor should it be interpreted as professional guidance on sanctions compliance, AML compliance, KYC compliance, CTF compliance or related matters. No representation nor warranty is made with respect to the availability of the Service. Service level agreements are available for Clients opting for a Paid Service Agreement.
To our Clients who register an account with us ("Registered Clients"), we offer the functionalities of the Service referred to as being available to Registered Clients in section 4 of these Terms of Service (the "API and Batch Processing Service").
The AML Screening API and Batch Processing Service may be used by Registered Clients for free up to the specified number of requests per month advertised on our website. If a Registered Client wishes to make additional requests in a given month, the Registered Client may submit a credit card in the account area, from which we will debit the amount advertised on our website for each request that exceeds the free requests per month.
Lower rates, based on a certain monthly fee are available under Paid Service Agreements.

We do not guarantee, represent or warrant that our Service will be uninterrupted, timely, secure and error-free. Further we do not represent or warrant that the results that may be obtained from the use of our Service will be accurate, reliable, complete and current. We undertake no obligation to update, amend or clarify information or data in our Service or on any related website, including without limitation, pricing information, except as required by law.
We do not review, verify or in any other way check the data we receive from the Data Sources.
While we do regularly update the data forming the basis of our Service, no representation or warranty is made in this regard.
